Latest Drone Laws In Montenegro

My drone and I finally visited Montenegro. It was a recent visit. 

My aim was to capture the delightful vistas of this beautiful country. And I’ll highly recommend this place to every aerial photography enthusiast.

I’m always looking for a trouble-free experience so I extensively researched the latest drone laws in Montenegro. Here I’m sharing them with you so you can enjoy a responsible yet worry-free flight.

Overview of Drone Regulations

The Civil Aviation Authority of Montenegro oversees the drone laws Montenegro. 

All drones are expected to follow the conditions laid down in Regulation on Conditions for Use of Unmanned Aircraft Systems and Model Aircraft (“Official Gazette of Montenegro”, No. 11/16).

The broad guidelines of Montenegro drone regulations are as follows:

  1. Drone flights can only occur during the day.

  2. All drones are to maintain a minimum distance of 30 meters from people, animals, facilities, vehicles, vessels, other aircraft, roads, railways, water routes, or high-voltage cables.

  3. Drones must be flown within visual line-of-sight and within 500 metres from the pilot.  

  4. No drones are allowed in the controlled airspace.

  5. The maximum height for drone flights from the ground is 150 meters.

  6. Pilots are required to ensure that drone flights do not jeopardize lives or disturb the local peace and order.

  7. As per the Montenegro drone safety guidelines, it is the duty of the pilot to assess the flying conditions and ensure that the drone clears all obstacles during landing and take-off. 

Classification of Flight Area

According to the latest drone legislation Montenegro, the flight areas are classified based on the risk assessment. 

These are as follows:

  • Class I: Non-constructed area with no erected constructions or facilities and without any people, apart from the pilot and personnel required for flying.

  • Class II: An uninhabited built area with auxiliary commercial facilities or constructions which are not intended for staying of people.

    Where there are no people, apart from pilot and personnel required for flying, where only temporary staying is allowed, with no detaining of people through the area (bicyclists, pedestrians, etc.).

  •  Class III: Inhabited area with constructions or facilities primarily intended for staying, business, or recreation (apartment buildings, apartment houses, schools, offices, sports pitches, parks, etc.).

  •  Class IV: Areas of narrow urban zones (downtown, settlements, etc.).

Flight Operation Categories

There are four categories of flight operations in Montenegro – A, B, C, and D. These depend on the flight area and operational mass of the aircraft.

Category A

Low-risk flights with drones weighing up to 10 kg form part of this category. Such flight must occur in open areas without any construction/inhabited buildings/ people (Class I & II).

For such flights, the drone must carry a fire-resistant identification plate containing the identification mark along with the name, address, and contact number of the operator.

The minimum age for flying in this category is 16 years, and the pilot must submit either a Declaration or possess a pilot license.

Category B

Based on the drone operation rules Montenegro, Category B is applicable to drones weighing up to 15 kg and flying in areas that may be inhabited by people.

These include apartments, parks, offices, etc. (Class I, II, & III).

These flights also require the drone to have a fire-resistant plate with details as mentioned in Category A. 

The pilot’s age must be a minimum of 18 years and they must submit a Declaration from the pilot or possess a pilot license.

Category C

Drones weighing up to 20 kg fall in Category C. Besides the open and inhabited areas, Cat C flights can occur in congested areas of narrow urban zones (Class I, II, III, & IV).

For Cat C flights, the pilot must be 18 years of age or above and possess a pilot license or proof of passing the theory exam. This is required in addition to the Declaration of Pilot. 

It is mandatory for the pilot to have an Operations Manual on-site when conducting such operations.  

Category D

The flights in Category D are conducted with drones weighing between 10-20 kg and are considered the riskiest.

The flight area for such flights is Class III and IV, i.e. crowded/inhabited areas.

To fly in Cat D, the pre-flight preparation includes performing risk management activities if required.

Apart from that, all other rules as applicable to other categories apply here as well.

Drone Registration Montenegro

According to the latest regulation applicable from January 1, 2024, all drones flying in Montenegro need to be registered. This registration is mandatory for drones:

–  Weighing >250 grams

–  Possessing sensors that can capture personal data

–  That can transfer kinetic energy above 80 joules to humans upon impact.

Besides this, drone law compliance Montenegro mandates drone operators to have liability insurance contracts for damage to third parties.

Penalties For Violations

If you are found violating the drone laws in Montenegro then be prepared to face the Montenegro drone penalties! 

You would have to pay fines ranging from 500 to 2000 Euros. Or legal proceedings/drone confiscation for serious offenses.
